OK I wasn't going to say anything about this here but I am still rather shaken. I was assaulted this morning! Not badly and I am totally unhurt physically.

 

I'll try and keep a long story short (haha!)

 

I've said before that my father is suffering from dementia and is now in a nursing home. Whilst he was fit and well he amassed a portfolio of shares, property and other investments. One of the properties he had he actually turned over via a trust to all of his children - including me. It's about an acre of walled garden with a small open frontage. Over the years my father let some of the buildings there out to local businesses who needed space for materials or as workshops. Tenants came and went. Amongst these tenants was one particular so called builder (I say that because he is basically a cowboy) who has stayed for about 20 years and has basically trashed the place.

 

Anyway we decided that, after viewing the property and consulting with a solicitor, to give him his marching orders. He was given 3 months notice to remove anything he had stored there AND (very importantly) to clear the site up. This notice ran out at the end of last month.

 

We all figured that he would return after the end of this period and possibly keep on dumping building waste - he made very little effort to clean the place up. We have started on this getting specialist firms in at great cost to sort it all and take it away. We also stopped him sub-letting! The workmen he sub-letted too are now paying us direct. He was pulling in way more than he was paying us as rent. He hadn't had a rent rise in 15 years, which has lead us to believe that our father was actually suffering from dementia much earlier than previously thought. He didn't get all his money by not raising rents!

 

So I was driving home from our walk this morning when I was cut up by a van pulling across in front of me to access another road. It was this particular builder. Had he not done that to me I probably wouldn't have noticed him and just gone directly home. I realised that he was probably on his way to the gardens. So I turned around and made my way to the property. Sure enough he was there. Trespassing. Not only trespassing but removing things from various buildings. So I challenged him and he was very, very unpleasant with me.

 

I got on my phone to see if my brother was home for back-up but he was still at work (probably for the best really) so I asked his wife to call the police for me, I didn't know what the non emergency number was and my signal was very weak. She rang back to say she was just getting the message that they were experiencing an unusually high volume of calls. So I started taking photos of this guy and his son removing stuff whilst constantly repeating that they were trespassing and removing things unlawfully.

 

I had followed the older man into one of the buildings and thought I was on video but found out later I was just taking photos as he physically pushed me out of the door way to get out. I told him that was an assault. I then got my phone switched to video and caught him on camera as he exited his van and walked over to one of the entrances to the walled garden where I was standing. When he moved left or right I also moved in the same direction to block him - but not touch him - and he got fed up with that and barged into me and started kind of pummelling me with his forearms. It didn't particularly hurt but I stopped my commentary of "you are trespassing here, you are removing things unlawfully" to call out "oooww, oooww, oowww, stop hitting me". He laughed and just ducked in through another entrance.

 

I thanked him for giving me all the evidence I needed to take things further. I reminded him that he'd had a bloody good run at the gardens, buggering it all up with waste material and robbing slate of the roofs of the buildings and that we had been more than fair giving him 3 months notice to quit so he had no call to trespass. Now whatever happened would be on him because of his arrogance (he has an awful reputation round town for being an arrogant little tosser) and that as a family we were going to make sure he was called to account even if it meant him loosing his house. He owes money all over the place and can't get anything on credit at any of the builders merchants in the county. Our solicitor told us this. She has had dealings with him before and can't stand him.

 

Anyway I thought at this point I should go in case things escalated. I went round to my brother's and showed his missus the video I had taken and she was shocked by it.

 

I talked it through with a couple of friends who thought I should report the incident to the police before my brother, having got in from work, rang me to insist that I absolutely did. So I have.

 

The police officer I spoke to on the phone was lovely and told me that I had definitely suffered an assault and that they would take things further. He told me he would pass it on to local officers to come and view the video and take a statement. I said I wasn't particularly expecting to waste their time on something which was pretty trivial in the great scheme of things but which I wanted logged with them in case there were other incidents as clearly we would have to continue to police the site ourselves. I was worried that one of my brothers would loose his temper if caught in the same situation and end up assaulting this idiot so I wanted them to know what was going on at the gardens.

 

Anyway I have friends coming round tonight so I told the officer come before 5 tonight or otherwise just have someone pop in any time, any day over the rest of the week. Not 15 minutes later I got called by one of the local bobbies saying they couldn't get here before 5 but would I be up and around for an officer to call at 9am tomorrow morning. I said I would be but there was no rush to be told they took an incident like this very seriously. When I gave the name of the chap to the officer said "Oh Mr B******K, oh how VERY interesting. I know him of old". I was told that he would definitely be getting arrested and I had to be sure not to accidentally delete the video, which he had had me describe to him. Again this officer told me that I had definitely been assaulted. He also told me that he could by my voice that I was still upset and shaken.

 

So there you have it! I have had a bit of an exciting day. I only hope that the video I took is clear enough for the police to use in court. They seemed delighted that I have it.

flipping heck missus onetwo, you take it easy for a few days because shock can creep up on you , glad the police are being supportive and I hope the full force of the law is dished out on this dreadful man

Thanks Sam and Alicia. I must say this has upset me way more than it would have done when I was younger. One of my sister's, having watched the video which I sent to her via email, phoned me and she was STOTTING mad. She says if she has to use her own money to get this too court she will. As she's loaded that's no idle threat! I just need my brothers to keep cool heads on them and not go looking for this stupid man. They always spring to my defence but 2 of them in particular act first and think later. I just want to let the police handle it and hopefully justice, through the courts, will prevail. Yay!

I echo what Sam says - shock can be delayed, you are flooded with Adrenalin right now but when that wears off be prepared for it to hit you (((hugs)) what an awful bloke, it is assault, any time someone intentionally makes contact with you without your permission is an assault, if you have gained any marks or bruising tomorrow show those to the Police Officer and take photos as that could escalate the charge to ABH.

Thanks all for your concern. I came up to bed early, having taken migraine meds as I could feel one brewing but I can't settle and sleep won't come. I've been down to make myself a cuppa and eat a nice juicy peach as I thought I might need my glucose levels lifting a little. I missed my lunch and then didn't want any tea - so unlike me!

Marion, that is horrible. I am glad the police are taking action.

 

You ask what kind of day everyone else had? In my case an embarrassingly stupid one. Heat, humidity and headache put my brain on hold. Went into town, parked car, remembered I hadn't bought a ticket and went straight back and had already got a fine. Went to estate agent to place bid on house, got figures mixed up between mum's house which we are selling and the house I hope to buy, therefore stunned the agent by making an offer which was twice the asking price. She did query it at once, and we had a laugh before confirming the correct bid. Then thought I would have coffee and snack at nearby cafe. Bought, paid for, consumed and then I absent mindedly tried to pay for it again. Decided to spend afternoon at home to keep out of any more trouble. By evening when it got cooler, some of sanity returned and I walked Wispa for a couple of hours. Hope normal service will be resumed tomorrow.

Marion - you're a tough old bird but good on you for having the foresight to catch him on video. I hope that you're okay now and that he gets his just desserts :GroupHug: Please tell the police about the theft of stuff as well - the more they can get him for the better. Don't do anything like that again missus!

 

Was WFHing yesterday, so back to work today but I have Thursday/Friday off so a nice long weekend :)

Owl I am so sorry but you did make me laugh. Don't worry, you are not on your own. Like you and Sam I do things like that all the time. The other evening I was sitting engrossed with something on the internet when I suddenly realised I hadn't made a start on the evening meal and Ruby would be home for work in less than a half-hour. I rushed about making a one pot dish of rice and chicken, which only takes about 25 minutes to make. As I was leaning over the pan stirring it I felt the oven was hot against my legs. I then remembered that I HADN'T forgotten to make the meal - it was in the oven cooking and had been for a couple of hours!

 

So that's 3 places for Owl, Sam and me to be booked at The Home For The Terminally Bewildered. Any one else need a reservation making?

 

I've been up since 6.30am. I did manage to fall asleep around 1am and feel reasonably refreshed after 5.5 hours of sleep.

Yes, you can reserve a place for me! I just caught myself in time to stop putting Flash liquid cleaner into the washing machine instead of the non bio gel that it should have been, I poured juice instead of milk into my tea, and Rosie was baffled to be given a sachet of cat food for her breakfast. I blame the weather...nothing to do with my age!

 

Yantan, I second the remark about delayed shock, don't be surprised if you start telling someone about it and burst into tears. Please please if you see this man again however irritating he's being, don't go near him. If the Police have spoken to him he may seek revenge! I certainly hope he gets more than a stiff telling off.

 

I've not been sleeping well recently, staying awake for around three hours in the night. I had a headache I just couldn't shift yesterday so went to bed at 1, slept until 4 (eek!), then slept well last night and today headache has gone but I still feel knackered. Don't think my meds help, apparently tiredness is a side effect. I'm trying to get up the enthusiasm to saw down some very hefty branches at the end of the garden without them landing on the cats compound..wish me luck!

Suzeanna it's kinda reassuring that others do daft things like myself. Your place has been reserved. There's going to be a Refuge Corner in the home where Fugees will sit dribbling together.

 

Has anyone taken up a Wowcher offer? I seemed to have unintentionally signed up to getting emails from them sometime last week and today's offer of a 2 night stay in Germany and a visit to a Christmas market for £89 sounds a real bargain.
