Question For Legal Type Peeps

Watching the news last night they reported on the new council

appointed enforcement officers, who have the power to give

you a fixed penalty notice or demand your name & address.

 

As I walk my dogs and they generally go to the toilet

(which is the point really) I find the wording on the warning signs

vague. It states that I can be fined either £50 or £1000 depending on

where I am in the village if " I let my dog foul in this area".

 

So question is

 

What is the actual offence I can be in trouble for ?

 

1) Letting my dogs foul in the first place, or

 

2) failing to pick it up and dispose of it properly

 

Thing is I dont want some dog hating busybody getting all high on the power

he or she has been granted, and either fining me on the spot, or demanding where I live

 

The net result could possibly be a punch on the nose of said busybody.

 

Hope someone can clarify this..

I would ring your council and ask the question. Councils have a habit of placing their own interpretations on law. That way you will feel comfortable that you are doing precisely what your council is asking. Maybe put your request in writing so that you have a letter as proof of what you have been advised to do. I would have thought it would mean as long as you pick up afterwards you would be fine. We have signs in our neighbourhood that say any fouling will get you a £1,000 fine. It's ok if we pick up afterwards here though. Always check with your own local borough.

Do the signs say "dog foul the area" or "dog foul IN this area"? As my interpretation is that they mean two different things. This first implies leaving waste behind. The 2nd implies fouling but then cleaning up. Obviously it is irrelevant if dogs are not actually allowed in the area. The offence and powers are contained in the Clean Neighbourhoods and Environment Act 2005
