On July 1st Angela Smith MP will present a proposed amendment to the DDA.

This is only a 10 minute rule and is unlikely to get any further but if it gets support it might get a second reading.

For those who don't know the current wording:

 

 

 

 

 

1) If a dog is dangerously out of control in a public place—

 

(a) the owner; and

 

(b) if different, the person for the time being in charge of the dog,

 

is guilty of an offence, or, if the dog while so out of control injures any person, an aggravated offence, under this subsection.

 

 

Proposed

 

1) If a dog is dangerously out of control

 

(a) the owner; and

 

(b) if different, the person for the time being in charge of the dog,

 

is guilty of an offence, or, if the dog while so out of control causes injury or death, an aggravated offence, under this subsection.

Where a dog is seized under section 5(1) or (2) below and it appears to a justice of the peace, or in Scotland a justice of the peace or sheriff—

 

(a)

 

that no person has been or is to be prosecuted for an offence under this Act or an order under section 2 above in respect of that dog (whether because the owner cannot be found or for any other reason); or

 

(b)

that the dog cannot be released into the custody or possession of its owner without the owner contravening the prohibition in section 1(3) above,

 

he may order the destruction of the dog and, subject to subsection (2) below, shall do so if it is one to which section 1 above applies.

 

 

 

Proposed:

 

Where a dog is one to which it is alleged section 1 applies and it appears to a justice of the peace, or in Scotland a justice of the peace or sheriff—

 

(a)

that no person has been or is to be prosecuted for an offence under this Act or an order under section 2 above in respect of that dog (whether because the owner cannot be found or for any other reason); or

 

(b)

that the dog cannot be in the custody or possession of its owner without the owner contravening the prohibition in section 1(3) above,

 

he may order the destruction of the dog and, subject to subsection (2) below, shall do so if it is one to which section 1 above applies.

 

The changes to S3 IF passed would have MASSIVE consequences to ALL dog owners.

You will not that the changes to section 3 make it an offence to cause injury or death. They have removed "to any person" so if your dog injures or kills a cat, dog, hamster......

an injury does not mean a bite, so if your dog knocks over a child who then bumps his head............
