Mother tried to say that it was the first time and she didn't notice as she was on the phone . As the judge said the child was seen to inhale fully and puff out without any problems/ coughing etc - not what would happen if it had been his first cigarette. Yes, that was what I thought when I read it too. It seemed apparent it wasn't just a case of the child seeing mum having a sneaky fag in the garden and copying.
